Recommendation: Retain

The Eighth Judicial District Commission on Judicial Performance strongly recommends by unanimous vote that Judge Christine A. Carney BE RETAINED.

Judge Carney was appointed to the Larimer County Court in 1998.  Her cases are approximately one-half civil cases and one-half criminal cases consisting of misdemeanor and traffic offenses.  Prior to her appointment to the bench, Judge Carney practiced law for 17 years.

Judge Carney is currently the presiding County Court judge for Larimer County, having administrative responsibilities for the county courts, and is acting as a mentor judge of a newly appointed judge in Weld County.  Her administrative duties as presiding judge include participation in cooperative efforts to provide access to justice and to improve the operations of the criminal justice system with respect to county court cases.  Judge Carney engages in community service including participation in the High School Mock Trial Program.

The Commission interviewed Judge Carney, observed her in the courtroom, reviewed opinions authored by her, interviewed persons with significant contacts with Judge Carney, and considered the results of a survey of persons who have appeared before her as parties, attorneys, and jurors.  The survey rated Judge Carney in the areas of case management, knowledge and application of the law, communications, demeanor and diligence.  Attorneys responding to the survey rated Judge Carney significantly above the average for county court and trial judges in all five categories.

Ninety-eight percent (98%) of attorneys and ninety-four percent (94%) of non-attorneys favored retention of Judge Carney.  Ninety-five percent (95%) of attorneys responding and eighty-five percent (85%) of non-attorneys responding strongly recommended that Judge Carney be retained in office.
