The Second Judicial District Commission on Judicial Performance recommends that Judge John M. Marcucci BE RETAINED.

Judge Marcucci was appointed to the Denver County Court bench in February 1990. Prior to his appointment to the bench, Judge Marcucci was in private practice in Denver, specializing in criminal, bankruptcy and personal injury law. Judge Marcucci received his undergraduate degree from Regis College in Denver and was graduated from the University of Denver College of Law in 1978. Judge Marcucci presently hears civil cases. He has also served in traffic court; General Sessions trials for municipal ordinance violations; and criminal court.

The Commission reviewed written evaluations of Judge Marcucci from attorneys and non-attorneys, including written verbatim comments attached to the evaluation questionnaires. The Commission also considered a written self-evaluation completed by Judge Marcucci and conducted a personal interview with Judge Marcucci.

Judge Marcucci believes that it is important for judges to participate in community service to show that judges care about people and are not "programmed" in the law. He believes that community activities give judges life experiences which may assist them in making judgements. However, he also believes that judges should avoid activities in areas which might come before them in court. Judge Marcucci tries to take each case one at a time in his courtroom and ensure that each party feels that he or she has had their day in court. He works to keep the stresses and problems of each case with that case and not let them affect the way he views the other matters before the court. Judge Marcucci enjoys daily exercise, running, biking, ice skating and coaching girls' basketball. He has also coached soccer and is assisting the oldest of his three daughters in her head coaching debut. He enjoys instruction at the youth level.

Judge Marcucci received high ratings from both attorneys and non-attorneys in virtually every category, particularly in the areas of being courteous; treating all parties equally; communicating clearly, thoroughly and in a well-reasoned manner; maintaining proper judicial temperament; correctly applying the law; and performing with diligence, efficiency and minimal delay. Of the attorneys responding to the questionnaire, 100% recommended that Judge Marcucci be retained in office, 0% recommended that he not be retained, and 0% had no opinion. Of the non-attorneys responding to the questionnaire, 93% recommended retention, 3% recommended non-retention, and 4% had no opinion.
