Honorable Richard T. Gurley

Recommendation: Retain

The Twenty-First Judicial District Commission on Judicial Performance unanimously recommends that Judge Richard T. Gurley BE RETAINED.

Judge Gurley attended Creighton University and Indiana University, receiving degrees in business economics and public policy. He received his law degree from Drake University in 1986. He is currently pursuing a master’s degree from the University of Colorado in business administration and a master’s degree from the University of Nevada National Judicial College in judicial studies. Currently Judge Gurley volunteers at local high schools for speech and debate tournaments and is actively involved in the development of a mock trial team/program at Mesa State College.

Judge Gurley was sworn in as a District Court Judge on January 9, 2007. He previously was in private practice handling a variety of cases which included insurance defense, personal injury, workers compensation, criminal defense and civil litigation.

Judge Gurley was evaluated through the following methods: attorney surveys, non-attorney surveys, self-evaluation, courtroom observations, review of written decisions and an interview.

Attorneys and non-attorneys graded Judge Gurley above the average of all district court judges, statewide. Although there were isolated comments critical of Judge Gurley, the overwhelming comments and opinions were positive. Of particular note, the legal ability and even temperament of Judge Gurley were consistently referenced. Those surveyed commented that Judge Gurley’s decisions were easy to understand, that he maintained control over his courtroom, that he was courteous to participants and that he accurately and appropriately applied the law.

The Commission is impressed with Judge Gurley’s reviews and with him personally, through his interview and self-evaluation. It is clear that Judge Gurley gave attention to any negative feedback from the surveys and reflected as to how he could improve his service as a member of the judiciary. Judge Gurley is diligent and hard-working and has earned his reputation for excellent legal acuity through continued efforts to remain current in all aspects of the law.
