Honorable Brian Louis Green

Recommendation: Retain

The Eleventh Judicial District Commission on Judicial Performance unanimously recommends by a 10-0 vote that Judge Brian Louis Green BE RETAINED.

Judge Green was appointed as the County Court Judge for Park County on January 9, 2007. Before his appointment, Judge Green served as a Deputy District Attorney in the Eleventh Judicial District for two years. He received his law degree from University of Iowa College of Law in 1997. The Commission reviewed the results of surveys of lawyers and non-lawyers who were familiar with Judge Green's work and interviewed the Judge. Commission members observed Judge Green in court.

Judge Green approaches his job with a positive, but serious attitude. He is patient with litigants and strives to ensure that he is understood by those who appear before him, particularly by those who represent themselves. He treats everyone in the courtroom with respect and endeavors to explain the reasons for his rulings, particularly when sentencing. 

The Commission is impressed with Judge Green’s performance and potential as a new judge. It is expected that his performance will improve as he gains more experience on the bench. Judge Green's weakness is his lack of knowledge of some areas of law and procedure, and the perception by some that he may favor the prosecution in criminal cases. The latter opinion is reflected in the survey results, and Judge Green is aware of it. Judge Green had not dealt with civil or domestic relations matters before his appointment in 2007. Caseload statistics show that Judge Green runs his courtroom efficiently.

Of all attorneys surveyed about retention, 88% recommended to retain and 8% not to retain and 4% expressed no opinion.   Excluding those who had no opinion, 92% recommended to retain and 8% not to retain. Of all non-attorneys surveyed, 79% recommended to retain, 6% not to retain, and 14% expressed no opinion.  Excluding those who had no opinion, 92% recommended retention and 8% not to retain. (The percentages may not total 100% due to rounding.) The Judicial Performance Commission recommends that Judge Green be retained.
