The Eighth Judicial District Commission on Judicial Performance by a vote of 10-0 recommends that Judge Robert A. Rand BE RETAINED.

Judge Rand was appointed to the Larimer County Court bench in September 2009.  Judge Rand earned his undergraduate degree in criminology and his Juris Doctor from Florida State University.  Judge Rand practiced law in Florida prior to opening a private practice in Fort Collins that focused on criminal, bankruptcy, and domestic cases.  From 1980 through 1988 he was a prosecutor for the State of Florida.  His docket consists of civil trials, misdemeanor criminal matters, restraining orders, name change petitions, and evictions.

The Commission reviewed evaluation surveys, letters submitted by individuals, and the judge’s self-evaluation and written opinions; performed courtroom observations; interviewed representatives of the District Attorney and Public Defender Offices; and conducted an interview with Judge Rand.  Survey results for Judge Rand were generally positive.  Respondents described him as reasonable and effective.  There were both praises and complaints about his sentencing style which takes into consideration a wide variety of factors.

Of all attorneys surveyed about retention, 82% recommended to retain, 11% not to retain, and 7% were undecided or didn’t have enough information to make a recommendation.  Of those expressing an opinion to retain or not to retain, 87% recommended to retain and 12% not to retain.  Of all non-attorneys surveyed, 78% recommended to retain, 6% not to retain, and 16% were undecided or didn’t have enough information to make a recommendation.  Of those expressing an opinion to retain or not to retain, 93% recommended to retain and 6% not to retain.
